Covered Work

Qualifying work generally includes:

• Paver patios, walkways and driveways
• Natural stone patios and walkways
• Retaining walls and seat walls
• Natural stone walls and veneer
• Steps and landings
• Decks
• Fences
• Pavilions and pergolas
• Outdoor kitchens
• Fire pits and fireplaces
• Landscape lighting installation
• Other permanent improvements identified in the project proposal

If a covered workmanship issue occurs, Outdoor Living by Mr. Mulch will determine the appropriate repair or corrective action for the affected area.

Pavers, Walls and Hardscapes

Our workmanship warranty covers installation-related issues such as significant settlement, movement or failure that is directly caused by improper installation or base preparation performed by us.

Normal minor settlement, minor movement, color variation, efflorescence, surface variation and natural weathering are not considered workmanship defects.

Jointing sand, polymeric sand and similar materials are maintenance items and may require periodic replenishment.

Natural Stone

Natural stone naturally varies in color, texture, thickness, veining and surface characteristics.

Natural fissures, chips, mineral deposits, weathering, flaking, oxidation and color variation are not considered workmanship defects.

Our warranty covers the installation of natural stone, but does not guarantee individual stones against naturally occurring cracking, splitting, spalling or other material changes unless caused directly by improper installation.

Decks, Fences, Pavilions and Structures

Qualifying structures carry our 2-year workmanship warranty for installation performed by Outdoor Living by Mr. Mulch.

Normal expansion, contraction, checking, warping, fading, weathering and natural movement of materials are not considered installation defects.

Damage caused by storms, falling trees, impact, misuse or other outside forces is not covered.

Manufacturer Warranties

Many products we install include separate manufacturer warranties that may extend well beyond our workmanship warranty.

These may include pavers, decking, railing, fencing, pavilions, grills, fire features, lighting and other manufactured products.

Manufacturer warranties are governed by the individual manufacturer's terms and are separate from the Outdoor Living by Mr. Mulch workmanship warranty.

When appropriate, we are happy to assist customers with information needed for a manufacturer warranty claim.

Drainage and Grading

Drainage systems, French drains, grading and similar earthwork include a 1-year limited workmanship warranty unless otherwise stated in writing.

Because water movement can be affected by rainfall, groundwater, neighboring properties, soil conditions, irrigation and future changes to the property, drainage work cannot guarantee the complete elimination of standing water, flooding or water intrusion.

Sod

Sod installed by Outdoor Living by Mr. Mulch includes a 30-day limited establishment warranty, provided proper watering and care instructions are followed.

Sod loss caused by insufficient or excessive watering, irrigation problems, extreme weather, disease, insects, pets, traffic or improper maintenance is not covered.

Trees, Shrubs and Perennials

Trees, shrubs and perennial plants supplied and installed by Outdoor Living by Mr. Mulch include a 90-day limited plant warranty, provided proper watering and reasonable care are maintained.

Plant loss caused by drought, excessive watering, irrigation problems, extreme weather, insects, disease, animals, chemicals or neglect is not covered.

Annuals and seasonal plants are not warrantied after installation.

Approved plant replacements are limited to one replacement unless otherwise agreed in writing.

Grass Seed

Grass seed and seeded lawn installations are not guaranteed for germination or full establishment because results depend heavily on watering, weather, soil conditions, erosion and ongoing maintenance.

We warrant that the specified seed and installation work will be completed substantially as described in the project proposal.

Mulch

Mulch does not carry an ongoing warranty.

Mulch naturally fades, settles, decomposes and may move over time.

Our responsibility is to install the agreed-upon material substantially in accordance with the project proposal.

River Rock, Gravel and Decorative Stone

Decorative stone and gravel installations include a 30-day workmanship warranty.

Natural settlement, stone movement, weed growth, erosion, washout and material migration over time are considered normal maintenance conditions and are not covered.

Landscape fabric is intended to reduce weed growth but cannot completely prevent weeds.

Existing Work and Repairs

When we repair, restore, reset or add to existing work, our warranty applies only to the specific work performed by Outdoor Living by Mr. Mulch.

We cannot warrant the original construction, base, drainage, foundation or surrounding work installed by others.

Customer-Supplied Materials

Customer-supplied materials are not covered by our product warranty.

Our workmanship warranty applies only to the installation performed by Outdoor Living by Mr. Mulch, provided the supplied materials are suitable for the intended use.

Normal Maintenance

Outdoor spaces require ongoing maintenance.

Cleaning, sealing, re-sanding joints, weed control, mulch or gravel replenishment, watering, fertilization, lawn care, pruning, staining, painting and drain cleaning are considered normal maintenance and are not included under the workmanship warranty unless specifically stated in writing.

Conditions Outside Our Control

Our warranty does not cover damage or failure caused by conditions outside our reasonable control, including:

• Severe weather
• Flooding or excessive rainfall
• Drought
• Groundwater
• Unforeseen soil or subsurface conditions
• Erosion
• Tree roots
• Falling trees or limbs
• Animals or insects
• Fire
• Vehicle impact or overloading
• Misuse or neglect
• Deicing salts or chemicals
• Irrigation problems
• Utility work
• Changes to grading or drainage
• Alterations or repairs performed by others

Warranty Requests

Customers should notify Outdoor Living by Mr. Mulch promptly after discovering a potential warranty issue.

We must be given a reasonable opportunity to inspect the condition before repairs are performed by another contractor.

If the issue is determined to be covered, Outdoor Living by Mr. Mulch will repair or correct the affected portion of the work.

Payment and Project Settlements

Warranty coverage applies to projects that have been paid in full.

If a project balance is reduced, credited or otherwise adjusted as part of a negotiated settlement of a payment or project dispute, the Outdoor Living by Mr. Mulch workmanship warranty ends unless we specifically agree otherwise in writing.

Normal promotional discounts or discounts included in the original proposal do not affect warranty coverage.

If there is a legitimate problem caused by the way we installed your project during the applicable warranty period, we will address it.
